CONDITIONS OF SALE

The property described in this catalog, whether printed or posted online, as amended by any posted notices, online updates, or verbal announcements made during the sale, will be offered at public auction by PosterConnection, Inc. (“PosterConnection”) as agent for the consignor(s), subject to the following Conditions of Sale.

  1. Binding Agreement

By bidding at auction, whether in person, through an agent, by absentee, telephone, or online bid, or by any other means, the bidder agrees to be bound by these Conditions of Sale.

  1. Authenticity Warranty (90 Days)

PosterConnection warrants, for a period of ninety (90) days from the date of sale, that each lot is authentic as described. This warranty:

  • Is made solely by PosterConnection as agent for the consignor
  • Is non-transferable
  • Applies only to the original buyer of record
  • Is conditioned upon the return of the lot in the same condition as at the time of sale

The buyer’s sole and exclusive remedy for a breach of this authenticity warranty shall be rescission of the sale and refund of the original purchase price paid. No other remedy shall be available.

  1. Condition of Property; Condition Claims (30 Days)

All property is sold “AS IS” and “WHERE IS,” without recourse, and with all faults.

Condition descriptions are statements of opinion only and are provided for guidance. Buyers are strongly encouraged to inspect all items personally or through a knowledgeable agent prior to bidding.

A limited warranty regarding condition only is provided as follows:

  • Any claim relating to condition (including but not limited to paper loss, restoration, tears, stains, fading, or other physical defects) must be:
    • Made within thirty (30) days of the date of sale, and
    • Made only by the original buyer of record

Condition claims made after this period will not be considered.

Normal wear consistent with age, handling, and use is not grounds for a condition claim.

  1. Descriptions and Estimates

PosterConnection has made reasonable efforts to ensure the accuracy of catalog descriptions but makes no representations or warranties, express or implied, as to correctness.

Neither PosterConnection nor the consignor makes any warranty as to:

  • Year of publication
  • Measurements
  • Condition
  • Authorship or attribution
  • Provenance
  • Completeness
  • Translation of titles
  • Market value or estimates

All statements beyond basic identification are opinions only and are not guaranteed.

  1. Reserves

All lots are subject to a confidential reserve, which is the minimum price below which the lot will not be sold. Reserves may be published in the catalog or online, or may remain undisclosed. PosterConnection may execute bids on behalf of the consignor up to the reserve price.

  1. Bidding and Auctioneer’s Discretion

Bidding generally advances in increments determined by the auctioneer. The highest bidder acknowledged by the auctioneer shall be the buyer.

The auctioneer has sole discretion to:

  • Reject any bid
  • Vary bidding increments
  • Resolve bidding disputes
  • Reopen bidding or re-offer a lot

In the event of any dispute, PosterConnection’s records shall be final and conclusive.

  1. Absentee, Telephone, and Online Bidding

Absentee bids are executed as a courtesy and at the bidder’s risk. PosterConnection is not responsible for errors or omissions in executing such bids.

Telephone bids must be confirmed in writing prior to the auction.

Online bidding, including bidding through third-party platforms, is undertaken entirely at the bidder’s risk. PosterConnection is not responsible for:

  • Platform outages
  • Technical failures
  • Bidding delays
  • Platform record discrepancies

Third-party platform terms may apply in addition to these Conditions of Sale.

  1. Title, Risk, and Payment

Upon the fall of the auctioneer’s hammer:

  • Risk of loss passes immediately to the buyer
  • Beneficial title passes to the buyer
  • Legal title remains with the consignor until full payment is received

Payment is due immediately unless otherwise agreed in writing. Absentee bidders must pay no later than fourteen (14) days after the auction.

Late payments will accrue interest at 2% per month or the maximum rate permitted by law, whichever is less.

PosterConnection’s liability for failure to deliver any lot shall be limited solely to rescission of the sale and refund of the purchase price paid.

  1. Buyer’s Premium and Taxes

The purchase price consists of:

  • The final hammer price
  • A 20% buyer’s premium per lot
  • An additional 5% premium on purchases made through live online bidding
  • Applicable sales or use taxes, unless exempt

A minimum buyer’s premium of $15 per lot applies.

  1. Payment Methods

Payment must be made in U.S. currency by:

  • Cash
  • Money order
  • Zelle
  • Personal check (property released after clearance)
  • Bank wire transfer (buyer responsible for all fees)
  • Credit card (2.5% service charge)

California sales tax will be applied unless a valid resale certificate is provided.

  1. Packing, Shipping, and Export

Packing and shipping arrangements are made solely as a courtesy and entirely at the buyer’s risk.

PosterConnection assumes no liability for loss or damage arising from packing, handling, transportation, or shipment.

Buyers are solely responsible for:

  • Export permits
  • Customs documentation
  • Import restrictions
  • Compliance with all applicable laws
  1. Buyer Default

If a buyer fails to comply with these Conditions of Sale, PosterConnection may, without notice:

  • Cancel the sale and retain payments as liquidated damages, or
  • Resell the property publicly or privately

The buyer shall be liable for any deficiency, commissions, handling fees, legal fees, and related costs.

  1. Force Majeure

PosterConnection shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to acts of God, fire, flood, earthquake, war, labor disputes, transportation interruptions, or governmental actions.

  1. Governing Law

These Conditions of Sale are governed by the laws of the State of California. If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
